DMCA Policy

Instagram Bio Generator respects intellectual property rights and takes copyright infringement seriously. Here's how to report concerns and what to expect.

Reporting Copyright Infringement

If you believe your copyrighted work has been copied and posted on our Website in a way that constitutes copyright infringement, please submit a written notification to our DMCA agent.

Before submitting a DMCA notice, please consider the following:

  • Our tool generates text. Instagram Bio Generator creates short text suggestions based on user inputs. It does not host user-uploaded images, videos, music, or large blocks of text from external sources.
  • Fair use may apply. Some uses of copyrighted material may be protected as fair use. We encourage you to consider whether a use is transformative, educational, or non-commercial before filing a notice.
  • Misuse has consequences. Under the DMCA, any person who knowingly misrepresents that content is infringing may be subject to civil liability for damages, including costs and attorney's fees.

Required DMCA Notice Information

To be valid under the DMCA (17 U.S.C. § 512(c)(3)), your written notice must include all of the following elements:

  • Your Identity A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that is allegedly infringed. Include your full name and title if acting on behalf of an organization.
  • Description of the Copyrighted Work Identification of the copyrighted work you claim has been infringed. If you are claiming multiple works, a representative list of those works is acceptable.
  • Location of the Infringing Content Identification of the material that you claim is infringing and that is to be removed or access to which is to be disabled. Provide the specific URL(s) on our Website where the allegedly infringing content appears.
  • Your Contact Information Your name, address, telephone number, and email address so that we may contact you about your notice.
  • Good Faith Statement A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • Accuracy Statement A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
Important: Incomplete DMCA notices will not be processed. All six elements above are required by law. If your notice does not include all required information, we will inform you what is missing so you can resubmit.

DMCA Filing Process

Once we receive a properly submitted DMCA notice, we follow this process:

Notice Received

We receive your DMCA notice at dmca@yourdomain.com. We review it for completeness and confirm receipt within 2 business days.

Initial Review

We verify that the notice includes all required elements under 17 U.S.C. § 512(c)(3). Incomplete notices are returned with a request for the missing information.

Content Evaluation

We investigate the allegedly infringing content on our Website. We evaluate the specific URL(s) cited in the notice and determine what action is appropriate.

Content Removal

If we determine that the notice is valid, we will promptly remove or disable access to the allegedly infringing content and notify relevant parties.

Counter Notification Window

If applicable, the party who posted the removed content has the right to submit a counter notification. If a valid counter notice is received, we will notify you and may restore the content after 10–14 business days unless you notify us you've filed a court action.

Counter Notification Process

If you believe that material on our Website was removed or disabled as a result of mistake or misidentification, you may submit a counter notification to our DMCA agent. This right is protected under 17 U.S.C. § 512(g).

Please be aware that submitting a counter notification legally subjects you to personal jurisdiction in the federal court where you reside. You may also be liable for damages (including costs and attorney's fees) if you knowingly and materially misrepresent that the removed content is not infringing.

Counter Notification Requirements

A valid counter notification under 17 U.S.C. § 512(g)(3) must include the following:

  • Your Signature Your physical or electronic signature.
  • Identification of the Removed Content Identification of the material that has been removed or disabled, and the location at which the material appeared before it was removed.
  • Statement Under Penalty of Perjury A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Consent to Jurisdiction Your name, address, and telephone number, and a statement that you consent to the jurisdiction of Federal District Court for the judicial district in which your address is located, or if your address is outside the U.S., for any judicial district in which our service provider may be found, and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.

Repeat Infringer Policy

Instagram Bio Generator has a zero-tolerance policy for repeat copyright infringers. In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances, users or accounts that are deemed to be repeat infringers.

An account or user may be considered a repeat infringer if they are the subject of multiple valid DMCA notices, if they have demonstrated a pattern of infringement, or if they have submitted fraudulent or misleading content removal counter-notifications.

We also reserve the right to terminate any account or deny access to any user who misuses our platform to infringe on the intellectual property rights of others, regardless of whether a formal DMCA notice has been received.

Good Faith and Misuse of the DMCA Process

The DMCA process exists to protect copyright owners from genuine infringement. It is not a tool for censorship, competitive suppression, or harassment. We take misuse of the DMCA process seriously.

Under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that material or activity is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for any damages — including costs and attorney's fees — incurred by the alleged infringer, by the copyright owner, or by us.

We review all DMCA notices in good faith and will not remove content that is clearly within the bounds of fair use, publicly licensed, or otherwise non-infringing simply due to the receipt of a notice.

Frequently Asked Questions

How do I know if my content has been infringed on this website?

If you find your original written content, articles, bio copy, or other creative text published verbatim on our Website without your permission, that may constitute copyright infringement. If you're unsure, consider consulting a legal professional before filing a DMCA notice.

How long does it take to process a DMCA notice?

We aim to acknowledge receipt of all valid DMCA notices within 2 business days. Content removal, if warranted, typically occurs within 3–5 business days of receiving a complete notice. Complex cases may take longer.

What happens after I file a DMCA notice?

We will review your notice, investigate the claim, and if valid, remove or disable the infringing content. We will notify you of the action taken. If the affected party submits a valid counter notification, we will notify you and may restore the content after 10–14 business days if no court action is filed.

Can I file a DMCA notice if I'm outside the United States?

Yes. While the DMCA is U.S. law, our platform accepts international copyright infringement claims. Non-U.S. claimants should still follow the DMCA notice format, as it ensures your claim includes all the necessary information for us to act on it effectively.

What if I believe a DMCA notice was filed against my content unfairly?

You can submit a counter notification using the process outlined in this policy. A valid counter notification triggers a legal process that may result in restoration of your content. We recommend consulting with a legal professional if you believe your content was wrongly removed.

Does Instagram Bio Generator create original creative content that could be copyrighted?

Our tool generates short-form text suggestions (Instagram bios, typically under 150 characters) based on user inputs. Short phrases and common expressions are generally not protectable by copyright. However, if our output closely mirrors your original, copyrightable creative work, you may have grounds for a claim.
